This occurs in numerous ways including the concealment or destruction of exculpatory evidence; the failure to disclose exculpatory evidence to the defence; the failure to reveal that certain witnesses have been paid to testify; and the planting of incriminating evidence. An Innocence Project study found that 25% of DNA exonerations involved testimony that was known to be false by the police and another 11% involved the undisclosed use of coerced witness testimony. [31] In other words, over one third of these wrongful convictions involved prosecutorial misconduct. With the exception of the accused, the key roles in the criminal justice system were the sole preserve of men until after the end of World War One. Covey, Russell (2012–2013). Bowcott, Owen (October 11, 2018). "Failure to disclose vital evidence in criminal cases growing, says watchdog". The Guardian . Retrieved October 11, 2018. Makin, Kirk. "Guy Paul Morin Case". The Canadian Encyclopedia. Historica Canada . Retrieved March 23, 2016. Women – whether criminals or victims – are still subject to the most antiquated of double standards. “It is hard to get across the idea that a woman is entitled to have sex with the whole of the football team, but draw the line at the goalie,” writes Kennedy, with characteristic bite. Rape victims have their compensation reduced if they were drunk. Meanwhile, girls are being institutionalised (unlike adult courts, youth courts can sanction behaviour that is not technically criminal but may harm a child’s development) for behaviours that in their male contemporaries would be dismissed as “boys will be boys” but in girls are seen as evidence of dangerous moral turpitude. The sense of injustice can be a powerless motivational condition, causing people to take action not just to defend themselves but also others who they perceive to be unfairly treated. Injustice within legal or societal standards are sometimes referred to as a two-tiered system. [4] Relationship with justice [ edit ] See Chapter 8 "THE QUEST FOR JUSTICE" in Vol 2 of von Hayeks's The mirage of social justice (University of Chicago Press, 1978). For a list discussing dozens of writers who have stated down the centuries that injustice, not justice, is the primary concept, look out for the long footnote under the sub heading "Rules of just conduct are generally prohibitions of unjust conduct"

Having entered the university through a diversity programme (I was one of the few state school students on the course), I can appreciate the importance of such programmes. They couldn’t keep me there, but at least they got me there in the first place! For the first time enabling profoundly deaf people to sit on juries. Current laws ban the presence of a ‘stranger’ being in the jury deliberation room – this will be scrapped and instead allow a British Sign Language Interpreter into the room.Sensational. As a lawyer it is an insightful and necessary read but as a woman this book puts real evidence behind the injustices we as women know so well to be true.

O'Brien, B. As a Scot, Kennedy is clearly aware of this, so it’s a shame that it is not mentioned. Having read Eve Was Framed last year, I wasn’t sure whether I would find this book a simple repetition of the arguments presented. Whilst indeed there was a fair bit of crossover between the two books, this one still felt fresh and justified a book in its own right. Garrett, Brandon L.; Neufeld, Peter J. (2009).
